Information on the processing of personal data provided pursuant to article 13 of EU Regulation 2016/679 (hereinafter "Regulation")
Dear Interested Party ,
in this document, we inform you of the characteristics of the processing of your personal data (by way of example and not limited to, name, surname, telephone number, e-mail address) carried out by Abilio SpA (hereinafter "Abilio"). In particular, the following information is provided here:

3. On what legal bases and for what purposes does Abilio process your data?
The processing of your personal data is carried out by Abilio for the sole purposes reported in this information and exclusively in the presence of at least one of the following conditions:
a) Execution of the contractual relationship with Abilio and pre-contractual activities;
b) Fulfillment of legal obligations;
c) Consent for specific purposes;
d) Legitimate interest of Abilio.
The processing, therefore, is carried out in compliance with the conditions of lawfulness established by the Regulation and is limited to what is necessary for the performance, by Abilio and/or third parties on its behalf, of activities connected and instrumental to the following:
a) execute the contract and pre-contractual activities relating to the relationship between you and Abilio, including the management of judicial and extrajudicial disputes;
b) fulfill the legal obligations to which Abilio is required such as, by way of example, those in tax and accounting matters, prevention of the risk of money laundering and terrorist financing;
c) if you have given your consent, carry out activities aimed at continuously improving the service offered, such as:
- activities carried out by abilio with reference to i) the promotion of its own products and services, those of companies in the Group to which abilio belongs and/or third parties with which Abilio has distribution and/or partnership agreements, ii) the detection of the degree of satisfaction with quality of the services rendered and iii) the preparation of studies and market research;
- profiling activities aimed at analyzing consumer choices, browsing experiences and attention to the communication received so as to offer a more personalized service, targeted communication and a proposal of commercial offers that best meet your needs;
- online support activities through a live chat application made available by a third-party supplier or by contacting the contact details indicated by you.
- transfer of data to third party partners or companies belonging to the group, for the purpose of promoting products and services;
d) pursue Abilio's legitimate interest in protecting its interests and rights, after providing adequate information to the interested party and a balancing judgment aimed at verifying that such interests and rights do not compromise your fundamental rights and freedoms.
You will be able to register and subsequently access the site also via social login, i.e. using the account of some social networks, such as Facebook and Twitter. In this case, Abilio will only store the information from the indicated profile that you have expressly allowed to be transferred to Abilio. Under no circumstances will Abilio send information relating to your activity on the site to the social network. By accessing the social network used for registration, the relevant account will be used to register on the site. For further information on the transfer of data from the social network, please consult the privacy policy of the relevant social network.
It is specified that Abilio acts as Data Controller in relation to data relating to registration and navigation on online portals, as well as, in general, to those relating to your relationship with Abilio. With reference to the auction management activity, however, Abilio acts as External Data Processor appointed by the individual Insolvency Procedures - as Data Controllers - and on behalf of these. Within the limits of the specific purposes indicated above, the processing of your personal data is carried out using manual, IT and telematic tools.
Abilio adopts adequate organizational and technical measures to guarantee the security and confidentiality of your personal data, especially in order to reduce the risks of destruction or loss, even accidental, of data, unauthorized access, or unauthorized or non-compliant processing to the purposes of the collection.
4. To whom can the data be communicated?
Abilio may communicate your data to third parties belonging to the categories below:
a) for execution of the contract of which you are a party and pre-contractual activities :
- parent, controlled or associated companies pursuant to art. 2359 cc;
b) for compliance with legal obligations :
- subjects who carry out the audit and certification of the financial statements;
- authorities and supervisory bodies (Bank of Italy, MEF, CONSOB, EBA, others);
- judicial authorities;
- public subjects in the context of communications required by law (e.g. Revenue Agency);
- fraud prevention support company;
- archive established at the Ministry of Economy and Finance (hereinafter "MEF"), pursuant to articles. 30-ter, paragraphs 7 and 7-bis, and 30-quinquies, of the Legislative Decree. 13 August 2010 n. 141, exclusively for the purposes of preventing identity theft. The results of the verification procedure on the authenticity of the data will not be disclosed, but may be communicated to the authorities and supervisory and control bodies.
The same data will be processed by Abilio employees and collaborators, who have received specific instructions from the latter regarding the methods with which to proceed with the processing.
The natural and legal persons appointed as Data Controllers, as well as the authorized persons, may become aware of personal data in relation to the data necessary to carry out the tasks assigned to them.
Furthermore, for some services, the data may be communicated to companies that collaborate or use Abilio's services (for example subsidiary and/or parent companies; other real estate intermediaries with which there are partnership and/or collaboration relationships, banks or credit intermediaries for the proposal of financial products or other financial services connected to the sale of a property), with the sole intention of providing the services expressly requested by the User. In these cases the companies are independent owners, therefore Abilio is not responsible for the processing of data by them. Furthermore, Abilio is not responsible for the contents and compliance with the legislation regarding the protection of personal data by sites not managed by Abilio itself.
Personal data may also be transferred to countries not belonging to the European Union or the European Economic Area (so-called Third Countries) recognized by the European Commission as having an adequate level of protection of personal data or, otherwise, only if it is contractually guaranteed an adequate level of data protection compared to that of the European Union (e.g. through the signing of the standard contractual clauses provided by the European Commission).
5. How long is the data kept?
Abilio stores the data in a form that allows the identification of the interested parties for a period of time strictly necessary to achieve the specific purposes of the processing, without prejudice to any current regulatory obligations that impose a longer retention period.
With reference to the data relating to your registration on the portal, these will be kept for the entire period of registration for the service and no later than 60 days from the date of any revocation of the consent given by you, in compliance with any regulatory obligations that require a period longer than storage.
6. What are your rights?
We inform you that you, as the subject affected by the processing, can exercise specific data protection rights, reported in the following list:
- a) right of access : right to obtain confirmation from the Data Controller as to whether or not personal data is being processed and, in this case, to obtain access to the personal data and detailed information regarding the origin, purposes, categories of data processed, recipients of communication and/or data transfer and more;

b) right of rectification : right to obtain from the Data Controller the rectification of inaccurate personal data without unjustified delay, as well as the integration of incomplete personal data, also by providing a supplementary declaration; -
c) right to cancellation ("oblivion"): right to obtain from the Data Controller the cancellation of personal data without unjustified delay in the event that:- the. the personal data are no longer necessary for the purposes of the processing;

ii. the consent on which the processing is based is revoked and there is no other legal basis for the processing; -
iii. the personal data have been processed unlawfully; -
iv. the personal data must be deleted to comply with a legal obligation;
- d) right to object to processing : right to object at any time to the processing of personal data which has a legitimate interest of the Data Controller as its legal basis and/or to processing for marketing purposes, including profiling. In case of opposition to the processing for marketing, the personal data are no longer processed for these purposes;

e) right to limit processing : right to obtain from the Data Controller the limitation of processing, in cases where the accuracy of the personal data is contested (for the period necessary for the Data Controller to verify the accuracy of such personal data), if the processing is unlawful and/or the interested party has opposed the processing; -
f) right to data portability : right to receive personal data in a structured, commonly used and machine-readable format and to transmit such data to another data controller, if technically feasible, only for cases in which the processing is based on consent or contract and only for data processed via electronic means; -
g) right to lodge a complaint with a supervisory authority : without prejudice to any other administrative or jurisdictional appeal, the interested party who believes that the processing concerning him or her violates the Regulation has the right to lodge a complaint with the supervisory authority of the State state in which he habitually resides or works, or of the State in which the alleged infringement occurred.

7. How is profiling processing carried out for marketing purposes?
The profiling processing is aimed at personalizing the services and/or products that we offer you and concerns the personal data provided by you directly and/or indirectly, as well as those available/published on social networks, websites, external databases and public archives (e.g. ISTAT data). These data are processed in a pseudonymized form (therefore not allowing the identification of the subject to whom they refer) and to evaluate your interest in Abilio or third party products and to consequently offer you products and services that best meet your needs.
We also inform you that your personal data are subject to profiling processing for direct marketing purposes for a period not exceeding 12 months from their registration. This processing takes place only if you have given the relevant optional consent.
Your right to object at any time to profiling for the personalization of the commercial offer remains valid. In case of opposition, your personal data will no longer be processed for the aforementioned purpose.
The contents of the site - script code, graphics, texts, tables, images, sounds, and any other information available in any form - are protected in accordance with the legislation on intellectual works. All companies and products mentioned on this site are identified by their respective brands which are or may be protected by patents and/or copyrights granted or registered by the relevant authorities. The software products and information contents, unless otherwise specifically indicated, may be downloaded or used only for personal or non-commercial use, citing the source.
